Kaleiçi Property Rules: Listing Status, Tax and Permits
What should you check first when buying in Kaleiçi?
In Kaleiçi, a property's legal status matters before its location. Two buildings on the same street can differ in listing status, approved project and permitted use. The title deed, the conservation board decision, the approved project and the licences should be reviewed together before you discuss price.
Kaleiçi, built around Antalya's historic harbour, lies in the Muratpaşa district. The city's history reaches back to the settlement named Attaleia in the 2nd century BC, and Hadrian's Gate dates to AD 130. Many of the traditional two- and three-storey houses now serve as hotels, guesthouses, restaurants and bars.
6 checks before you buy
- Get the title record: Check for the annotation that the property is an immovable cultural asset requiring protection, as well as mortgages, liens and shared ownership.
- Confirm the listing decision and group: Ask for the regional conservation board decision and the Group I or Group II classification. Repair rules depend on this classification.
- Compare the approved project with the building: Have the room count, attic, courtyard and additions checked on site against the board-approved project.
- Verify the intended use: Confirm that residential, accommodation or commercial use is permitted today. A previous use does not by itself prove permission.
- Ask about the plan provisions: Obtain the current conservation plan provisions from Muratpaşa Municipality. A public notice process for the Kaleiçi plan provisions took place in 2025.
- Commission a technical inspection: Get a report from a qualified architect and engineer on the structure, roof, moisture, services and earlier repairs.

Taxes, fees and support: exemptions and their limits
A listed property is not automatically exempt from every tax. The outcome depends on the title annotation, the board decision, the type of use and whether the building complies with the law.

Legal consequences of unauthorised work
Physical intervention or a change of use contrary to board decisions is prohibited (Law 2863, Art. 9). Article 65 provides for 2 to 5 years' imprisonment and a judicial fine of up to 5,000 days for unauthorised construction or physical intervention. Unauthorised alterations and repairs that do not require a building licence can carry 6 months to 3 years' imprisonment or a judicial fine. Source: Law No. 2863
Accommodation and short-term rentals
Accommodation facilities must hold a Tourism Operation Certificate or a Simple Accommodation Certificate to operate. Under Art. 7/8 of the regulation, a simple accommodation certificate cannot be transferred except through inheritance or a testamentary disposition. Before buying, ask the provincial directorate who holds the certificate and how this affects you.
Law No. 7464 requires a permit to rent out a home for tourism for up to 100 days. As a rule, the permit requires the unanimous decision of all flat owners in the building. Being in a tourist area does not remove this requirement.

Why we do not publish an average price per m² or a payback period
We could not find current, official price or yield data specific to Kaleiçi. An asking price is not a sale price, and listing group, restoration condition, permitted use and paperwork can make two nearby properties very different in value. Price and return should therefore be assessed after reviewing the documents and actual income and expense records of the specific property. You can test your own scenario with the rental yield calculator; the result is neither a forecast nor a guarantee.
Frequently asked questions
Is every building in Kaleiçi listed?
No, this should not be assumed. Being inside a conservation site is not the same as a building being individually listed. Check each property through its title record and the regional conservation board decision.
Is a listed property always free of property tax?
Not always. Properties with the title annotation are exempt, but in metropolitan areas the exemption does not cover half of the property tax on commercial use outside the simplified regime. It also does not apply until any illegal structures or additions are removed.
Who approves alterations to a listed building?
Depending on the scope of work, the regional conservation board and municipal procedures apply. Ask the relevant authority before starting, because unauthorised work can lead to criminal penalties.
Will the hotel certificate pass to me when I buy?
Do not assume so. The certificate type and holder matter, and transfers of the simple accommodation certificate are restricted other than through inheritance. Get written information from the Provincial Culture and Tourism Directorate before signing.
Can I rent out my Kaleiçi home by the day?
Tourist rentals of up to 100 days require a permit under Law No. 7464. As a rule, all flat owners in the building must agree unanimously.
